RESULTS

In accordance with Section 2.3(D) of the Governance and Administration Regulations of the Puerto Rico Plan of Adjustment Pension Reserve Trust and Monitoring of Plan of Adjustment Pension Benefits (the “Guidelines”) and Article 6.1 of the Election Regulations approved on April 19, 2023, by the Pension Benefits Council during the Transition Period (the “Election Regulations“), Kroll Restructuring Administration LLC (“Kroll”), as the Election Administrator, tabulated the votes cast during the election period. 

This website constitutes the Election Results Notice under Section 2.3(E) of the Guidelines and Article 6.6 of the Regulations.

In accordance with Section 2.3(F) of the Guidelines and Section 6.7.1 of the Election Regulations, any candidate may challenge an election by submitting a written appeal to the Pension Benefits Council, to be received by the Council within ten (10) calendar days after the election results are mailed and posted on the Pension Benefits Council’s website. Therefore, the 10-day period will begin on October 24, 2023. If no challenge is filed, these results shall become final and binding.

Certification of Results

Report on the Status of the Elections and the Commencement of the Pension Benefits Council Following the Conclusion of the Transition Period

On October 24, 2023, the Notice of Election Results was issued, through which the Election Administrator mailed notification to the candidates regarding the results of the process. One of the candidates, who competed in the Teachers Retirement System, challenged the election results within the established timeframe. Pursuant to the Guidelines governing the process, the case was referred to arbitration.
 
On March 4, 2024, the arbitrator assigned to the case issued a resolution and award dismissing the appeal filed and confirming the results of the election held for the Teachers Retirement System. The Arbitration Regulations provide that a party adversely affected by a resolution or award may file a motion for reconsideration within ten (10) days from the date of notification. 
 
The appealing party did not request reconsideration, and through a Corporate Resolution dated March 15, 2024, the Pension Benefits Council certified the Election Results. The elected members will begin their terms on April 1, 2024, after receiving the initial orientation and formally accepting their positions through a public deed.
